Section 1

Acceptance of Terms

By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or platform notification.

Section 2

Eligibility

To use our platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using financial services under applicable law
• Reside in a jurisdiction where our services are permitted
• Successfully complete our KYC (Know Your Customer) verification process

We reserve the right to refuse service to anyone at our sole discretion.

Section 3

Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information
• Keep your password secure and not share it with third parties
• Notify us immediately of any unauthorised access to your account
• Not create multiple accounts or impersonate another person
• Not use automated tools to access or interact with the platform

We are not liable for losses arising from unauthorised account access caused by your failure to safeguard your credentials.

Our Services

Tesla Investment Management provides the following services through its platform:

• Crypto-funded wallet for deposits and withdrawals
• Fixed-ROI investment plans managed by our team
• Real-time stock market data and trading execution
• Tesla vehicle marketplace and purchase facilitation
• Portfolio tracking and performance analytics

We reserve the right to modify, suspend, or discontinue any service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation of services.

Section 5

Wallet & Funds

Deposits are accepted via cryptocurrency (Bitcoin, Ethereum, Litecoin) and credited to your account balance upon admin verification. You acknowledge that:

• Deposits are subject to review and may be delayed or rejected
• Withdrawal requests are processed manually and may take 1–5 business days
• We are not responsible for funds lost due to incorrect wallet addresses provided by you
• Cryptocurrency transactions are irreversible once broadcast to the network
• We reserve the right to hold or freeze funds suspected of fraudulent origin

Your account balance is denominated in USD. Cryptocurrency values are converted at the prevailing market rate at the time of processing.

Section 6

Investment Plans

Our investment plans offer fixed ROI returns over defined durations. By subscribing to a plan, you acknowledge:

• Returns are not guaranteed and depend on plan terms set by us
• Your principal is locked for the duration of the plan
• Payouts are processed manually by our team upon plan maturity
• Past performance does not guarantee future results
• We may cancel plans under exceptional circumstances, refunding your principal

Investment plans are not regulated financial instruments. You invest at your own risk. We strongly recommend only investing funds you can afford to lose.

Section 7

Stock Trading

Stock prices and market data are sourced from third-party providers (Finnhub) and are provided for informational purposes. You acknowledge:

• Market data may be delayed and is not guaranteed to be accurate or complete
• Stock purchases are executed at the prevailing price at time of order
• All trading activity is subject to your available account balance
• We do not provide investment advice or recommendations
• You are solely responsible for your trading decisions and any losses incurred

Section 8

Vehicle Orders

Vehicle purchases through our marketplace are processed as follows:

• Payment is deducted from your account balance immediately upon order confirmation
• Orders are placed in "pending" status until processed by our team
• Delivery timelines are estimates and subject to availability
• Vehicle specifications and pricing are subject to change without notice
• Cancellations must be requested within 24 hours and are subject to approval

Tesla Investment Management acts as a marketplace facilitator. Vehicle warranties and after-sales service are governed by the manufacturer's terms.

Section 9

Prohibited Use

You agree not to use the platform for any of the following:

• Money laundering, fraud, or any illegal financial activity
• Circumventing KYC/AML requirements
• Manipulating market data or exploiting platform vulnerabilities
• Creating fake accounts or impersonating other users
• Uploading malware or conducting cyberattacks
• Violating any applicable local, national, or international law

Violation of these prohibitions may result in immediate account suspension, fund freezing, and reporting to relevant authorities.

Section 10

Limitation of Liability

To the maximum extent permitted by law, Tesla Investment Management and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or investment returns
• Loss of data or platform access
• Damages arising from market volatility or third-party data errors
• Unauthorised access to your account due to your negligence

Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the total fees paid by you to us in the 12 months preceding the claim.

Section 11

Termination

We may suspend or terminate your account at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Suspected fraudulent or illegal activity
• Failure to complete KYC verification
• Extended period of account inactivity

Upon termination, your right to access the platform ceases immediately. Any outstanding balance will be processed for withdrawal after a review period, subject to applicable legal holds.

You may close your account at any time by contacting support. Pending transactions will be completed or reversed before closure is finalised.

Section 12

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Austin, Texas, except where prohibited by law.

You waive any right to participate in class action lawsuits or class-wide arbitration against Tesla Investment Management.
